What is licensing?
Art licensing gives you permission to use artwork in your business. For instance, you might license one of my designs to include on a product you sell.
Licenses may be exclusive or non-exclusive and are typically granted for a set period of time.
Non-Exclusive License
A non-exclusive license grants you the right to use one of my designs on your products. The same design may also be licensed to other businesses and may be made available for sale by me through selected platforms and retailers.
All designs remain the intellectual property of the artist, and full copyright is retained at all times.
A separate license is not required for the sale of finished goods created using fabric featuring my designs, provided the fabric has been purchased through authorised fabric retailers.
Exclusive License
An exclusive license is tailored to your specific needs, with terms agreed upon individually for the use of the design.
Exclusivity is defined by both product category and territory. For example, an exclusive license for childrenswear within the EU would prevent the design from being licensed to other businesses for the same category within that territory. However, I may still license the design for use in other regions or for different product categories (such as wallpaper or stationery).
All designs remain the intellectual property of the artist, and full copyright and ownership are retained at all times.
At the end of the agreed license term, you will be granted first right of renewal. Should you choose not to renew, all rights revert to me as the artist.
